These Terms and Conditions (“Terms”) apply to all services, systems, and messaging provided by ClickCapture, LLC (“ClickCapture,” “we,” “our,” or “us”). By purchasing, accessing, or using our services, you agree to be bound by these Terms.
1. SMS & Messaging Disclosure (A2P 10DLC)
By opting in to receive SMS or MMS messages from ClickCapture, you consent to receive text messages related to account notifications, system alerts, service updates, authentication (2FA), and other business-related communications.
Message frequency may vary.
Standard message and data rates may apply based on your mobile carrier.
To opt out at any time, reply STOP to any message.
For assistance, reply HELP.

2. Messaging Consent
You must explicitly consent to receive messages from ClickCapture. Consent may be provided through website forms, account sign-up, service onboarding, or other explicit opt-in methods. You may withdraw consent at any time by following the opt-out instructions above.
3. Message Delivery Disclaimer
ClickCapture does not guarantee uninterrupted or error-free delivery of messages. Delays or failures may occur due to carrier issues, network conditions, device limitations, or other factors outside our control.
4. Services Provided
ClickCapture provides predefined, systemized growth solutions that may include website infrastructure, lead follow-up workflows, review automation systems, communication tools, and related software access.
ClickCapture does not provide custom marketing campaigns, manual lead responses, or bespoke consulting services unless explicitly agreed to in writing.
Services are delivered on a subscription basis and are designed to operate automatically once configured.
5. Subscription Plans & Billing
ClickCapture offers subscription plans billed on a month-to-month basis, unless otherwise stated.
All subscription fees are billed in advance of the service period.
Subscriptions automatically renew unless canceled prior to the next billing cycle.
Payments are processed securely via Stripe using a valid credit or debit card.
Discounted longer-term options may be offered from time to time but do not alter the core terms of this agreement.
6. Setup Fees
Certain plans may include a one-time setup fee covering system configuration, integrations, and initial activation.
Because setup work begins immediately upon purchase, setup fees are non-refundable once configuration has started.
7. Usage-Based Charges (Rebillable Costs)
Some services incur third-party usage-based costs, including but not limited to:
Phone numbers
SMS/MMS messaging
Voice calls
These charges are passed through at cost and billed based on actual usage. Usage details are visible within your account dashboard. ClickCapture may maintain a usage balance or auto-top-up system to ensure uninterrupted service.
8. Refund & Cancellation Policy
Subscription services are month-to-month and may be canceled at any time prior to the next billing cycle to avoid future charges.
Subscription fees already paid are non-refundable.
Setup fees are non-refundable once setup has begun.
ClickCapture may, at its discretion, offer remedies if a service issue arises shortly after onboarding. Our goal is long-term partnerships, not forced retention.
9. Chargebacks & Disputes
If a chargeback or payment dispute is initiated, ClickCapture reserves the right to submit documentation including service access, system configuration, usage records, and acceptance of these Terms to the payment processor.
Fraudulent or abusive chargebacks may result in immediate account suspension or termination.
10. Payment Failures & Suspension
If a payment attempt fails, ClickCapture may retry the charge multiple times. Accounts with unpaid balances may have services temporarily suspended until payment is resolved.
11. User Obligations
You agree to use ClickCapture services in compliance with all applicable laws and regulations. You may not use our systems to send unlawful, abusive, misleading, or harmful communications.
12. Compliance With Laws
All services must be used in accordance with applicable privacy, telecommunications, and commercial communication laws, including but not limited to TCPA and CAN-SPAM regulations.
13. Changes to These Terms
ClickCapture reserves the right to modify these Terms at any time. Updates will be posted on our website or communicated directly where appropriate. Continued use of services after changes constitutes acceptance of the updated Terms.
